In accordance with the Digital Millennium Copyright Act (“DMCA”), we have adopted the following policy regarding copyright infringement on our platform, https://codebuysell.com. Upon receiving your DMCA notice, CodeBuySell will review and process it according to the procedures outlined in this policy.
3. Counter-Notification
If you believe that your material was mistakenly removed (or access was disabled) in response to a DMCA notice, you may submit a counter-notification to request the reinstatement of the material. A counter-notification must include the following:
- Identification of Material: Specify the material that was removed or to which access was disabled, including the location where the material appeared before removal.
- Statement of Good Faith: Include a statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification.
- Consent to Jurisdiction: State that you consent to the jurisdiction of the federal district court in the judicial district where your address is located, or if you reside outside of the United States, that you consent to the jurisdiction of any judicial district in which CodeBuySell may be found.
- Contact Information: Provide your contact details, including full name, mailing address, telephone number, and email address.
- Signature: Include your physical or electronic signature.

Please Note: When we receive a valid counter-notification, we may reinstate the material unless we receive notice from the original complainant that they have filed a legal action against you within 10 business days.
4. Repeat Infringer Policy
CodeBuySell has a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We reserve the right to suspend or terminate accounts if we determine that the user has repeatedly engaged in copyright-infringing activities, including when a user has received multiple DMCA notices.
5. CodeBuySell’s Actions Upon Receipt of a DMCA Notice
When we receive a DMCA notice, we will review it to confirm it meets the necessary requirements. If the notice is valid, CodeBuySell may take one or more of the following actions:
- Removal or Disablement: We may remove or disable access to the infringing material.
- Notification: We will notify the user who posted
To reinforce compliance and promote ethical affiliate practices, the following guidelines are established in addition to our general Affiliate Agreement terms, with specific reference to our DMCA Policy and protection of intellectual property rights.
6. Affiliate Responsibilities and Obligations: Supplementary DMCA Compliance
- Respect for Copyright and Intellectual Property Rights:
- Affiliates must uphold CodeBuySell’s DMCA Policy by refraining from promoting or endorsing any products, listings, or materials that infringe on third-party copyrights, trademarks, or other intellectual property rights.
- Affiliates are responsible for verifying that all content they promote aligns with applicable copyright laws and respects the rights of content creators and vendors.
- Prohibited Content:
- Affiliates are prohibited from using or linking to pirated, cloned, or counterfeit digital products or assets. Affiliates must only promote original, authorized, and legally obtained content through their referral links to maintain the integrity of the platform and adhere to DMCA regulations.
- Affiliate Action in Case of DMCA Notices:
- If a product promoted by an affiliate is flagged for DMCA violations or removed due to a copyright infringement claim, any commissions generated from the sale of that product may be forfeited.
- Affiliates must discontinue promotion of the flagged product and remove any promotional content linked to the disputed material to ensure ongoing compliance with the DMCA Policy.
- Promotional Content Review:
- CodeBuySell reserves the right to review and audit the affiliate’s promotional content for compliance with copyright regulations and our DMCA Policy.
- Affiliates found in violation of these terms may face account suspension, termination from the affiliate program, or forfeiture of any pending commissions for the disputed content.
- Affiliate Education on Copyright:
- Affiliates are encouraged to familiarize themselves with copyright and intellectual property principles to ensure that they can confidently support CodeBuySell’s DMCA Policy. Resources or guidance may be available upon request.
- Legal Consequences:
- Affiliates acknowledge that CodeBuySell is not responsible for any legal actions arising from their independent promotional activities. Affiliates are solely liable for legal repercussions if their marketing practices infringe upon third-party rights or violate DMCA policies.
By adhering to these additional provisions, affiliates help uphold a fair marketplace on CodeBuySell and contribute to a safe and legally compliant environment for customers, vendors, and the CodeBuySell community.
